Scope of present reflective essay is based on the explanation of key issues of detailed case of Shamima Begum, who planned to re-enter in the UK. This reflective essay revolves around the case scenario of Shamima Begum, a 24 year old girl who left UK to join Islamic group in Syria, which is termed as responsible for the organisation of terrorist attack across world. In 2019, when she plans to re-enter within nation, her citizenship was refused by the UK government as per the grounds of maintaining national security (Oxford Human Rights Hub, 2024). During re-entry in 2019, when she applied for citizenship in UK government, she was liven in Syria’s refugee camp and was expecting. Her advocate has made an appeal before court to revert decision which was granted and passed by special Immigration Appeal Commission. However, during research, it was highlighted that her application got rejected by stated it unlawful as Shamima was treated as Bangladesh citizen by descent. This was the primary reason due to which her citizenship got terminated and rejected by the UK government (Adeani et al, 2020). While research on the current case, my critical thinking skills were improved that helped me to analyse the facts and information to form a conclusion.

Apart from that, as per my view, another reason behind dismissal of citizenship is that she went to Syria on her own will , was not forced by anyone and established there as local immigrant resident. Therefore, as per the UK’s citizenship act, her citizenship got restricted (Markkanen et al, 2020). The present case helped me to develop my research skills as it assisted me to connect with the case facts and guides me to formulate conclusive results. Further, it helped me to collect and analyse key information about regulations and rules related to re-entry and citizenship by UK and Bangladesh government. Appropriate research on the citizenship policies and regulations will enhance my learning about government responsibilities related to maintaining peace and security of the nation (Farrell, 2022). In addition, I learnt about the concept of citizenship and key regulations related to its dismissal, helps me to ascertain key issues of current case in more detailed manner. This will allow me to comply with the legal rule of citizenship and assists me to create a positive impact on society and also will help me to work in public interest and NGOs.

The primary issue related to the current case study is based on the ground of citizenship removal at the Special Immigration Appeal Commission (SIAC) in 2023 (Negrin et al, 2022). In my opinion, her citizenship is not lawful within UK as she become resident of Syria and also, Shamima has Bangladesh citizenship by descent. In that case, she went to Bangladesh government for justice related to the resolution of citizenship issue. However, during current research in present case, I leant about the citizenship policies of both UK and Bangladesh have single citizenship, due to which Bangladesh government also refused to decide this case and dismissed her entry within nation. This becomes potential issue in the current case that how Shamima’s citizenship was removed by the Special Immigration Appeal Commission (SIAC) (Shaw, 2020).

As per the Gibbs model of reflective cycle, I felt extremely nervous and frustrated about completion of assignment on time as I don’t have enough knowledge about the regulatory polices of UK and Bangladesh, came as a challenge. However, research skills helped me to gain new information about regulations and policies related to citizenship (Lister, 2020). In addition, I gained knowledge about nation’s concern behind the dismissal of citizenship; assist me to evaluate facts of current case study with the legal regulations of citizenship in UK. Along with that, Internet and online resources helped me a lot to collect key information about this case, makes me feel confident and happy. At last, with smart division of time, I managed to complete this assignment before deadline, as a reason of which I feel satisfied.

Another key issue in the case study was related to the grounds behind the reason to move to Syria. It was contended against SIAC that Shamima begum was a victim of sexual exploitation and human trafficking due to which her citizenship was granted by UK government (Bevan, 2022). However, this contention was rejected by the UK court as it does not falls within the nation’s jurisdiction as she was not treated as citizen of The UK. It was stated by the judges during judgement that may be Shamima is manipulated and influenced by someone but her decision to move to Syria and alignment with the Islamic state, which is liable for conduct terrorist attack across world, is not justified (Garvill, 2020). This case study helped me to acquire knowledge related to the responsibilities of the UK government among which maintenance of nation’s safety and security is its primary one. Also, the present case study will assist me to function as per the regulatory framework of the government. This will help me to become a responsible citizen by ensuring proper compliance of legal policies and regulations in order to maintain nation’s welfare and security.

As per the Gibbs reflective cycle, I evaluated that my time management skills are good due to which I was able to complete this assignment on time. In addition, strong research skills assist me to collect adequate knowledge about this case (Nyamutata, 2020). In addition, it guides me to evaluate key facts of case as a result, I was able to evaluate situation of the current case study. For example: as per my opinion, Bangladesh government can consider the situation of Shamima as she has Bangladesh citizenship by descent. But, it was also revealed that she moved to Syria to gain learning and different insights about Islamic region. In that case, previous decided judgements of case law helped to evaluate facts and decision, results in increased learning on legal concepts and regulatory procedures (Hong, 2021). Besides that, critical thinking skills were improved during research on this case study, as this case study assignment empowered me to think in critical manner by ascertaining all the facts and scenarios.

However, I analysed that poor communication skills results in compounded mistakes, leads to break the flaw of conclusion and strategic analysis of the case. Due to limited communication during research, relevance and visibility was adversely impacted, emerged as a weakness (Masters and Regilme Jr, 2020). In that case, theory of experimental learning will help me to improve skills of communication by offering me a chance to learn through practical scenarios. The present case guides me to gain experimental knowledge through implementation of multiple skills and knowledge in the practical scenario. Furthermore, the experimental learning theory aims to improve analytical thinking skills by providing synthesis and active experimentation (Bean and Melzer, 2021). This will also help in my future career as with the improved communication skills, I will foster effective relationship with team members and colleagues. In addition, this will help me to communicate thoughts and messages in effective manner, facilitates better understanding and improves efficiency and chances of success of project.

Besides that, the current research study strengthens my decision making skills, assist me to identify that decision made by UK government is in people’s interest and emerges as an ethical option. Facts of the present case study revealed that Shamima does not have the citizenship of any nation, whether it’s UK, Bangladesh or Syria (Sari and Prasetyo, 2021). In that case, as per my opinion, country cannot detain the right of citizenship before asking to a person. It is mandatory for government of UK to inform the person about the detention of citizenship right before make her statelessness. In my opinion, pre-information about the refusal or detention of citizenship right offers chance to person about taking corrective measures actions. In addition, it was outlined that citizenship of the person can be refused or terminated in special circumstances only (Cortázar et al, 2021). However, according to me, situation of detention of citizenship in the present case taken by the government of UK was done in the favour of public welfare and good, due to which, Shamima was not termed as statelessness person.

In addition to that, as per the scenario of present case study, it was identified that Shamima obtains the citizenship right from her parents, not from any sort of fraudulent activity. In addition, she does not engage in any unlawful activity or hazardous actions which are against the welfare of nation (Amin et al, 2020). Therefore, in my opinion based on the above facts and moral grounds, citizenship to Shamima must be provided by the government of Bangladesh as she has pure bona fide intentions to came back and obtain citizenship. On contrary, Gibbs reflective model helps me to analyse to focus on the information and details of the case. This helped me to enhance my analytical thinking and decision making skills. Furthermore, it also makes me realize that I had limited skills of planning, results in restricting abilities to handle excessive information and reduces focus during the completion of task (Sari et al, 2021). To overcome this issue of limited planning skills, theory of constructivism will help me to enhance my skills based on the prior knowledge. Also, this theory will boost my confidence and morale due to which I will complete my future assignments in more effective and better manner. Apart from that, during the completion of assignment, I discovered about new concepts and legal terminologies, helps me to enhance my legal knowledge. In addition, I analysed that my critical thinking skills were improved due to which I came to finish this assignment with high accuracy and efficiency.

Moreover, my writing skills are also developed as I learn about writing in legal and precise manner with clarity to minimize chances of confusion and ambiguity. Gibbs reflective model helped to analyse skills based on strengths and weaknesses (Wolters and Brady, 2021). This will help me to overcome potential weaknesses in skills, leads to better professional career in future. Also, the present case highlights about ISIS return persons and Shamima is termed as one of them. It was revealed that UK government ensures that there are no ISIS people allowed within nation as they are full of negative intentions and ill feelings towards nation (Masters and Regilme Jr, 2020). According to my point of view, UK government have the detention right to prevent people from negative impact of ISIS people as they have proper knowledge and training about working in illegal manner against nation.

On contrary, during this current case study, I analysed my weaknesses, such as limited communication skills and planning skills due to quality and efficiency of research has been little impacted. However, an action plan was formulated with the implementation of active listening strategy and establishment of positive environment and culture, communication issues could be effectively mitigated (Nyamutata, 2020). Also, strategy of building of emotional intelligence and identification of communication objectives, issue related to weak communication skills could be resolved. In addition to that, poor planning skills will be mitigated by proper organization of research tasks and activities. This will help in the creation of systematic schedule of work, results in completion of assignment in accurate and effective manner (Lister, 2020). Also, development of systematic research plan and implementation of brainstorming strategy will further assist me to improve planning skills.

Conclusion and Recommendations

It was conclude that this reflective essay was based on the case study of Shamima, treated as an ISIS return due to which her citizenship was detained. This case study helped me to analyse the key issue involves in this case related to dismissal of citizenship and statelessness. During completion of assignment, multiple skills related to time management, strategic thinking, decision making, writing skills and problem solving were emerged as strength as these skills helped me to complete my project on time. On the other hand, I realized that there were chances of improvement in communication and planning skills. This reflective essay summarizes about evaluation of multiple legal concepts and their impact on the current case and practical learning. Besides that, the above study highlighted about the gained practical knowledge and its significance in future professional career. Based on that, here are some recommendations for resolution of case, which are as follows:

  • It is recommended to the UK Government that they might not accept Shamima’s citizenship as it will affect overall operation and welfare in adverse manner. Also, The UK’s citizenship policy stated that individuals of UK have possessed citizenship of one nation only. However, Shamima have already possessed citizenship of Bangladesh by descent. Apart from that, it is mandatory for the government to protect the nation from illegal and negative people came from Syria to ensure fair working and wellbeing of Nation by dismissing citizenship of people who returns from Syria (Markkanen et al, 2020).
  • In addition to that, it is suggested that UK government that It can take appropriate action by offering protection and assistance to Shamima begum and to reconsider and review the decisions related to citizenship revocation by considering judgements of previous cases with similar facts. This will help the UL government and court to promote trust and maintains loyalties of stakeholders such as public, prosecutors and respondents that it works for the promotion of well-being of the nation (Bean and Melzer, 2021). In addition, it will help people to understand that decision of UK government related to dismissal of citizenship was not termed as statelessness as it this decision was bound by public policy, that is to promote welfare of the state.
  • On the above analysis and evaluation of case study, it is recommended to Bangladesh government that it must review its citizenship policies and procedures and reconsider about shamima’s citizenship. It was revealed that she has obtained citizenship of Bangladesh by descent (Sari and Prasetyo, 2021). Therefore, on moral grounds. It was suggested to Bangladesh government abut reviewing its policies of citizenship, also she was not engaged in any sort of illegal activities which are against nation’s public policy.
